General Conditions of Leave:
Leave can not be claimed as of right
In case of exigency of public service any kind of leave may be refused or revoked.
Govt of India Decision:
Govt. servants are encouraged to avail leave regularly
Leave should not be denied ordinarily during the last 10 years of services.
One kind of leave may be converted into another kind of leave by submitting written request to the leave sanctioning authority within 30 days from the date of return to the duty.
Any kind of leave under this rule can be taken in combination or in continuation with other leave under this rules.
Casual Leave is not under this rule and no other leave is taken in combination or in continuation with Casual Leave except Special Casual Leave and where Special CL is not combined with other leave.
Leave can not be taken continuously for 5 years except in case of medical case with disability.
EarnedLeave (EL) (Rule 26)
Leave account is credited with EL in advance in 2 installments of 15 days each on the first day of January and July. (yearly 30 days)
Earned Leave in leave account will be accumulated up to 300 days only.
Maximum EL granted at a time is 180 days if served in India
More than 180 days but not more than 300 days for Group A & B officer while they are outside India and her neighboring countries for full or part of the period.
Calculation of EL: (Rule 27)
🔘 EL shall be credited to the leave account at the rate of 2 1/2 days for the completed calendar month of service.
Example: if any one is joining the duty on 15th January 2024, then his leave account for the first half of 2024 will be credited with 13 days of EL (5motnhs * 2 1/2 =12.5 rounded off to 13), here January month is not calculated, February to June 5 completed calendar month will be calculated.
🔘 If any Govt Employee avail Extra Ordinary Leave (EXOL) or some of his service is treated as Dies non in a half year, then the credit to the EL in the next half year will be reduced by 1/10 th of the said period or maximum 15 days.
Example: If a govt servant avails a 50 days EXOL or 50 days dies non in first half of 2024, then in July 2024 his EL credit will be reduced by 1/10 th of 50 days i.e. 5 days and his EL credit will be 10 days (15-5= 10) on July 2024.
Half Pay Leave (HPL) (Rule 29)
Leave account is credited with HPL in advance in 2 installments of 10 days each on the first day of January and July. (yearly 20 days)
EL shall be credited to the leave account at the rate of 5/3 days for the completed calendar month of service.
If any Govt Employee avail Extra Ordinary Leave (EXOL) or some of his service is treated as Dies non in a half year, then the credit to the HPL in the next half year will be reduced by 1/18 th of the said period or maximum 10 days.
Commuted Leave (Rule -30)
Granted on the medical purpose & approved course of study certified to be in the public interest.
Avail up to half of the credited HPL.
After granting of commuted leave, twice of the HPL will be debited.
For study purpose it is allowed maximum 180 days.
60 days commuted leave with out medical certificate to female govt servant in case of adoption of child.
Medical certificate is not necessary in commuted leave in continuation of maternity leave.
